The Egg Industry Stabilisation Act, 1971 (Act No. 74, 1971) provided for the establishment of a Poultry Farmer Licensing Committee. A poll of 'prescribed persons' who would have been eligible to vote if a poll had been taken under the Marketing of Primary Products Act, 1927 (1) was to determine whether the Committee would be established. The Act prescribed that the date of the poll was to be published in the NSW Government Gazette, that it was necessary that sixty percent of eligible persons cast votes and that the majority of these must vote in favour of establishing a Committee. The regulations which were published in the NSW Government Gazette on 19 May 1972 set out the procedures for the poll. The poll was taken on 11 August 1972. (3) The poultry farmers voted in favour of establishing a licensing Committee and the Committee was proclaimed to commence on 1 December 1971. (4) The Constitution of the Committee was set out in the Egg Industry Stabilisation Act, 1971. The Committee was initially to consist of the members of the Egg Marketing Board for New South Wales (5) whose officers were at the disposal of the Committee (6). The Act also set down the process for the dissolution of the Board. The Poultry Farmer Licensing Committee was responsible for the issue of licences to commercial poultry farmers, and permits for poultry breeders and hatcheries. The Committee established quotas and approved the transfer of quotas in the keeping of hens by licensed poultry farmers. (7) The Committee was empowered to cancel licenses and permits for any breaches of the conditions specified in the license or permit (8). This Egg Industry Stabilisation Act, 1972 was repealed by the Egg Industry Act, 1983 (Act No. 57, 1983) which re-constituted a Poultry Farmer Licensing Committee (9) of four members appointed by the Minister. One of these shall 'by the instrument by which he is appointed' be designated as Chairman, two members represent the New South Wales Egg Corporation and be members of it and the fourth member is to have qualifications the Minister believes to be appropriate.
