Act No.42 of 1906 provided that any improvement lease which had been the subject of inquiry by the Royal Commission on the Administration of the Lands Department would be cancelled, due to having been granted irregularly. The former lessee became the holder of a preferential occupation licence for such land while applying for an improvement lease under section 18 of the Crown Lands Amendment Act of 1903. A board was appointed to deal with these forfeited leases and to ascertain whether the former lessee should have a preferential right to the improvement lease or whether such lease should be by auction or tender.
