Full description

On 1 July 2009 the Department of Justice and Attorney General was established as one of thirteen Principal Departments of the Public Service under the Public Sector Employment and Management (Departmental Amalgamations) Order 2009. The Department of Justice and Attorney General was responsible to the portfolios of Attorney General and Corrective Services. (1)

All branches of the former Attorney General's Department and the former Department of Corrective Services were added to the Department of Justice and Attorney General. (2) Also the groups of staff in the Office of the Director of Public Prosecutions and the Office of the Legal Aid Commission who were principally involved in the provision of corporate services and who were required in connection with the Department of Justice and Attorney General were removed from those Offices and added to the Department of Justice and Attorney General. (3)

From 4 April 2011 the name of the Department of Justice and Attorney General was changed to the Department of Attorney General and Justice [II]. The Department became one of nine Principal Departments. The Department of Attorney General and Justice [II] was responsible to the Attorney General and the Minister for Justice. (4)

On 24 February 2014 the Public Sector Employment and Management Act 2002 (Act No.43, 2002) was replaced by the Government Sector Employment Act 2013 (Act No. 40, 2013). Under the Constitution Act 1902 (Act No.32, 1902) the Administrative Arrangements Order 2014 was issued to commence on 24 February 2014. The Order abolished all principal departments under the former act however they were re-established with the same name as Departments under Schedule 1 of the Government Sector Employment Act. For all purposes the re-established Department of Atttorney General and Justice was the successor and a continuation of the former principal Department. (5) The Government Sector Employment Act replaced the former position of Director General of the Department of Attorney General and Justice with Secretary of the Deparment of Attorney General and Justice. (6)

On 23 April 2014 the name of the Department of Attorney General and Justice was changed to the Department of Police and Justice. (7)

On 1 July 2014 the name of the Department of Police and Justice was changed to the Department of Justice. (8)

On 1 July 2019 the Department of Justice was abolished. Its former staff combined with those from the former Department of Family and Community Services to become the Department of Communities and Justice. (9)
