Primary Applications are applications which were made to LPI [Land and Property Information] by owners of land under Old System title, (a system of Title base on Common law principles and that relies on a chain of documents as evidentiary to ownership of land), for conversion to the Torrens Title system, that provides one State guaranteed title document evidencing ownership.
Primary Applications may also be used to remove a Caution on a qualified Torrens Title, the caution being a warning that a Torrens Title may be subject or affected by interests not recorded, investigate or disclosed.
In a Primary Application the applicant is required to provide all documents that support a “good root of title” i.e. essentially a chain of documents that support ownership and any other interests that affect that title to land.
Part of the examination processing by LPI of a Primary Application involved LPI officers undertaking searches of LPI’s Old System records on the basis and in conjunction with the records supplied in the Primary Application. One of the resulting reports from the search conducted is known as an epitome of title.
The epitome of title will show in chronological order the devolution of title to the land in the application from a selected commencement point to the date of the search and will include reference to all documents whether registered or not appearing to affect the title over the period searched.
This report and other reports are relied on by LPI’s Legal officers in approving the application and providing direction on how the unqualified Torrens Title should issue.
Epitomes of title prepared by LPI officers bearing the same number reference as Primary Application have been made available as a public record under the description of Primary Application Search books or the Primary Application Miscellaneous Search Books. Epitomes included in the record set being, Primary Application Miscellaneous Search Books are searches that involved in the level of searching required and or have some level of complexity.
Primary Application Miscellaneous Search volumes contain the applications lodged and supporting documentation required to undertake the search. Records are organised numerically by Primary Application Miscellaneous Search number. Although most volumes were section-sewn into bound volumes, a small number of volumes were stab-sewn, and others were arranged loosely into empty covers which were fastened with legal tape. This series has been dis-bound in preparation for preservation digitisation.
