Full description
These volumes comprise copies of all decrees and orders in Equity made by the Primary Judge in Equity, puisne judges or the full court (on appeal), together with orders or decrees issued in accordance with the courts. Additional functions, ie. in the administration of idiots' and lunatics' estates, and the care and guardianship of infants. Each entry shows the date of the order, the names of the litigants and the direction of the court. In some cases, in addition to the substance of the court order or direction, the nature of the petition, plea or motion placed before the court is described. Orders granted by the court upon petition or motion cover the entire range of the court's jurisdiction, and include orders to revive (causes), to allow further time for pleading, to obtain decrees ex parte (eg. in the event of the opposite party not putting in an appearance), to pay moneys, deliver possessions, lands, tenements, hereditaments, or to attach or sequester.
In some cases orders direct litigants to refer to the Chief Clerk in Equity (or, at a later date, to the Master), who was required to submit a report to the court on the matter referred to him (eg. assessing appellant's security for prosecution of appeal, calculation of principal and interest on a mortgage, or taxation of costs incurred).
Orders awarding injunctions against litigants proceeding at law were also awarded upon motion.
