The Hunter District Water, Sewerage and Drainage Act 1938 (Act No.11, 1938) (1) repealed the Hunter District Water and Sewerage Act, 1892-1928 and constituted the Hunter District Water Board, as an independent financing and constructing authority with powers to set up its own staff, borrow moneys and acquire equipment to carry out water, sewerage and drainage projects.

The Board comprised a President and Vice-President appointed for seven years by the State Government, and five members elected for a period of four years, representing constituencies of Municipalities and Shires within the district of Newcastle. The Hunter District Water Board assumed office on 7 December 1938. (2)

The function of the Board was financing the construction, maintenance and administration of the water supply, sewerage and storm-water drainage works within its area of operations - the cities of Newcastle, Greater Cessnock and Maitland, as well as the Municipality of Lake Macquarie and the Shire of Port Stephens.

In February 1988, the Board was reconstituted as the Hunter Water Board under the Hunter Water Board Act 1988 (Act No.119, 1988). (3)

The Hunter Water Board (Corporatisation) Act of 1991 (4) repealed the Hunter Water Board Act and created the Hunter Water Corporation as a State Owned Corporation.
