Full description

The Compensation Court of New South Wales was formed by the Compensation Court Act, 1984 (Act No.89, 1984) on 3 December 1984. (1)

The Compensation Court consisted of a Chief Judge and any other judges that may be appointed by the Governor. Only one Judge was required to constitute a Court. (2) The Act also made provisions for the appointment of Commissioners who could hear and determine compensation matters up to $40,000 (excluding hospital and medical expenses), appeals against the decisions of taxing officers and any matter referred to them by a Judge. (3) The Court was responsible for resolving disputes that arose regarding the payment of accident-related compensation under various Acts. These acts included the Workers' Compensation Act, 1987 (Act No.70, 1987), Workers' Compensation (Dust Diseases) Act, 1942 (Act No.14, 1942) and the Sporting Injuries Insurance Act, 1978 (Act No.141, 1978). (4) The Compensation Court was also required to liaise with the State Compensation Board once every six months. (5)

The Compensation Court Repeal Act, 2002 (Act No.23, 2002) transferred the functions of the Compensation Court to the District Court of New South Wales and to the Workers Compensation Commission. (6)
