The University Council is the governing body of the University of Newcastle. It was created by sections 8 and 9 of the University of Newcastle Act, 1989, as the successor to the earlier University Council which had governed the University during the years 1965 - 1989 (although an interim Council filled the role from 1 September 1989 until 1 September 1990). The Council was constituted as follows:
A member of the Legislative Council (elected by the Council)
A member of the Legislative Assembly (elected by the Assembly)
The Chancellor (unless he is otherwise a member of the Council)
The Vice Chancellor
The Presiding member of the Academic Senate (unless this is the Vice Chancellor) or the deputy presiding member of the Academic Senate (if the presiding member of the Vice Chancellor)
Four persons appointed by the Minister. These persons were to have expertise in the fields of education and the arts; industry, commerce and industrial relations; or to be past or present members of a profession.
Two representatives of the academic staff
A representative of the non-academic staff
A representative of the students who it not a member of the academic or non-academic staff
Four representatives of convocation who are not members of the academic or non academic staffs or students
One other person could be appointed by Council. The qualifications and the method of electing the members who were representatives was to be set down in by-laws. (1) The functions of the Council were to :
provide such courses and confer such degrees, diplomas and certificates as it thinks fit;
appoint and terminate apppointments of University staff;
manage and control the University
borrow money or renew existing loans to enable the discharge of its functions
invest money
establish and participate in trusts, companies or bodies which promote the objects and interests of the University
engage in the commercial development of discoveries, inventions or intellectual property in which the University has a right or an interest
establish and maintain branches and colleges of the University within in its grounds and elsewhere
make loans and grants to students
impose fees charges and fines (2) The functions of the Council could be delegated to one of its members, a Committee or an officer or authority of the University. Section 9 of the University of Newcastle Act, 1989 was proclaimed to commence on 1 September 1990. (3) Council met for the first time on 14th September, 1990, and thereafter met every second month.
