The Appeal Costs Board was established under section 4 of the Appeals Costs Fund Act 1964.

The Board administered a fund designed to assist a particular party to legal proceedings to pay legal costs incurred as a result of circumstances beyond the control of the party.

For example this may include circumstances such as a retrial following a disagreement by a jury, a court error or a question of law where there had been some irregularity in proceedings.

The Chairperson and the members of the Board were appointed by the Attorney-General for a period of three years.
