AGY-5058 | Special Inquiry into certain management practices of the Totalizator Agency Board [Public Service Board]

Full description

On 29 March 1983 the Public Service Board was directed by the Premier to conduct a Special Inquiry under Section 101 of the Public Service Act, 1979, into the management practices of the Totalizator Agency Board.

The Public Service Board delegated the conduct of the Special Inquiry to its chairman, Mr David Moore. Mr David Kirby was appointed Counsel Assisting the Inquiry instructed by Mr Leigh Sheridan from the State Crown Solicitor's Office and Mrs Margaret Cunneen was appointed the Secretary of the Inquiry.

The Terms of Reference of the Special Inquiry included the direction from Premier Neville Wran to examine the management practices of the Totalizator Agency Board in relation to:
a) circumstances associated with the Internal Audit Report of November 1982 concerning [an employee] and leading to his subsequent retirement.
b) the circumstances leading to the retirement of [an employee].
c) the reporting to the Board of the circumstances of the retirements of [two employees].
d) the policies and practices of the Totalizator Agency Board in converting Branches to Agencies.
e) the policies and practices of the Totalizator Agency Board in the allocation of Agencies.
f) whether the superannuation payments to [two employees] were in accord with the normal conditions of the Totalizator Agency Board's superannuation scheme.
g) whether there has been improper conduct by the Totalizator Agency Board, the General Manager, or staff in relation to the circumstances of the retirements of [two employees].
h) whether agreements made between the Totalizator Agency Board and [two employees] for the allocation of agencies are binding on the Board. (1)

The Inquiry presented its report to the Premier on 9 February 1894.
