Water Trusts were constituted under Part III of the Water Act, 1912 (1). Section 31 of the Act gave the Minister for Water Resources the power to construct, acquire, and utilise works for the purpose of water supply, irrigation, drainage, and flood prevention and control. The Minister would then constitute a Trust for the maintainance, administration, and extension of such works (2). The Womboin No.1 Bore Water Trust was thus constituted, being proclaimed 6 May, 1924 (3). Bore Water Trusts are located in the Artesian Wells District of northern New South Wales. They were established to encourage landholders residing within the environs of a well to participate in the administration of water usage and in the maintainance of the well and drainage channels (4). The Womboin No.2 Bore Water Trust comprised of elected local landholders and a senior Water Conservation and Irrigation Commission or Water Resources Commission official. The main function of the Trust was to set and collect the water rates within the Trust District (5). Section 59 of the Water Act, 1912, stipulated that if there is a delay in the election of Trustees, or if the Trustees default in the discharge of their duties, the Governor may if in his opinion sufficient reason exists dissolve the Trust and remove from office the Trustees (6).
