On 1 May, 1880 public instruction and related educational and cultural responsibilities were removed from the Department of Justice and Public Instruction establishing a separate Department of Justice. (1) These arrangements were confirmed by a notice published in the Government Gazette of 15 September 1880 which detailed the government offices over which the new Minister for Justice presided including:
a) the office of Chief Justice, the Puisne Judges;
b) the Supreme, Circuit and District Courts;
c) Sheriff's Department;
d) Petty Sessions;
e) Office of the Chairman of Quarter Sessions;
f) Insolvency Court;
g) Police Magistrates;
h) Coroners;
i) Gaols and Penal Establishments;
j) Patents;
k Copyright Registry;
l) Sydney and Suburban Cemeteries;
m) all matters relating to the commutation or remission of sentences other than capital, and reformatory institutions;
n) administration of Act relating to Newspapers. (2)
On 1 January 1882 the Minister of Justice was given oversight of the Licensing Act, 1881 (45 Vic Act No. 14). Administering this Act and its successors took up a great deal of departmental time in later years.
On 1 August 1901, the Department of Attorney General and the Department of Justice were amalgamated into the Department of Attorney General and of Justice. (3)
