Orders-in-Council can cover any subject. They are used to get the Governors signature on anything that needs it. Matters needing the Governors signature include Regulations and, where required by an Act, Board appointments and resignations, proclamations, government guarantees, etc. Orders-in-Council are used by the whole of Government.Treasurys Cabinet and Parliamentary Liaison Section receives a request for an Order-in-Council. This comprises a draft Order and supporting documentation. The supporting documentation is in the form of a Parliamentary Counsels memorandum for Regulations, and an Explanatory Memorandum for anything else. Resignations will include a letter of resignation addressed to the Governor.
The Section prepares an Agenda Sheet for the signature of the Secretary to the Department of the Treasury. The Agenda Sheet comprises a list of Orders, by title, of all Orders being forwarded on one occasion.
All the above papers are forwarded to the department of Premier and Cabinet as happens throughout government. A copy is kept at Treasury. The copies are destroyed after a few years. DPC keeps the Agenda Sheet.
After approval by the Governor the Orders are returned to the Section. The Section makes a copy of the signed Order and the supporting papers, and forwards the copies to the author. The originals are kept together in a lever-arch folder.
This series comprises bound and unbound orders submitted by the Treasury to the Executive Council (also constituted as the Governor-in-Council) for the Governors approval. These orders span the full range of Treasury functions and responsibilities including schedules of (staff) appointments, proclamation of relevant Acts/regulations and finance, expenditure and appropriation approvals.
The Orders kept by Treasury relate only to functions administered by Treasury.
